Please read these Terms of Service ("Terms") carefully before using the t3xt.email service operated by t3xt.email ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using our email-to-SMS service ("Service"), you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

t3xt.email provides a platform that converts incoming emails to SMS/MMS messages and broadcasts them to designated recipients. The Service includes email address provisioning, phone number assignment, member management, and message delivery via third-party carriers.

3. Your Responsibilities

You are solely responsible for:

  • TCPA Compliance: Obtaining proper prior express written consent from all recipients before adding them to any list. You must comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal, state, and local laws regarding SMS/MMS communications.
  • Message Content: Ensuring all messages sent through the Service are lawful, not misleading, and do not contain prohibited content including but not limited to: illegal content, harassment, spam, malware, or content that violates third-party rights.
  • Opt-Out Processing: Honoring all opt-out requests. While our Service automatically processes STOP/START keywords, you must not re-add opted-out recipients.
  • Accurate Information: Providing accurate account and billing information and keeping it current.
  • Account Security: Maintaining the confidentiality of your account credentials.

4. Prohibited Uses

You may not use the Service to:

  • Send unsolicited messages or spam
  • Send messages without proper recipient consent
  • Transmit illegal, harmful, or offensive content
  • Impersonate others or misrepresent your identity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any systems
  • Use the Service for any purpose that violates applicable laws

5. Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Message delivery depends on third-party carriers and networks outside our control.

We may modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

6. Message Delivery Disclaimer

WE DO NOT GUARANTEE MESSAGE DELIVERY. SMS/MMS delivery is subject to factors beyond our control, including but not limited to:

  • Carrier network availability and policies
  • Recipient device status (powered off, out of range, blocked numbers)
  • Carrier filtering and spam detection
  • Network congestion or outages
  • Third-party service provider issues (Twilio, carriers)

You acknowledge that missed, delayed, or undelivered messages may occur, and we shall not be liable for any damages resulting from such occurrences.

7. Billing and Payment

Subscription fees are billed in advance on a monthly basis. Message usage is tracked according to your plan limits. Overage charges apply when you exceed your plan's included messages.

No Refunds: All fees are non-refundable except as required by law. Message credits are non-refundable and non-transferable.

8. Carrier Registration (10DLC/A2P)

Important Carrier Compliance Notice

United States mobile carriers require registration for Application-to-Person (A2P) messaging using 10-digit long code (10DLC) phone numbers. This registration is managed by The Campaign Registry (TCR) through our SMS provider, Twilio.

Our Obligations: We maintain the required platform-level registrations with Twilio and carriers to enable A2P messaging through our Service.

Your Obligations: By using the Service, you acknowledge and agree that:

  • Your use of the Service constitutes consent to register your messaging campaigns with carriers through our Twilio account.
  • You will provide accurate business information when creating your account, as this information may be submitted to carriers for verification.
  • Carriers may filter, block, or limit messages based on content, volume, or compliance violations, and we are not liable for such carrier actions.
  • Campaign registration may take several business days to process, during which message delivery may be limited.
  • You will comply with all CTIA (Cellular Telecommunications Industry Association) guidelines and carrier-specific policies.

Registration Fees: Carrier registration fees, if any, are included in your subscription. We reserve the right to pass through any future carrier-mandated fees with 30 days notice.

8. Limitation of Liability

IMPORTANT — PLEASE READ CAREFULLY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL T3XT.EMAIL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOST PROFITS, REVENUE, OR DATA
  • BUSINESS INTERRUPTION
  • LOSS OF GOODWILL OR REPUTATION
  • DAMAGES ARISING FROM MISSED, DELAYED, OR UNDELIVERED MESSAGES
  • DAMAGES ARISING FROM SERVICE DOWNTIME OR UNAVAILABILITY
  • DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • DAMAGES ARISING FROM YOUR VIOLATION OF TCPA OR OTHER LAWS

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Liability Cap

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO T3XT.EMAIL DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

10. Indemnification

You agree to defend, indemnify, and hold harmless t3xt.email and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws, including TCPA
  • The content of messages you send through the Service
  • Your failure to obtain proper consent from message recipients
  • Any claim by a third party related to messages you send

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the decision of the arbitrator shall be final and binding.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
