Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the t3xt.email service ("Service"). Violation of this policy may result in immediate suspension or termination of your account.

1. Prohibited Content

You may not use the Service to send messages containing or promoting the following content categories (commonly known as "SHAFT" content):

  • Sex/Adult Content: Sexually explicit material, adult entertainment, dating services with sexual content, escort services, or pornography.
  • Hate: Content promoting discrimination, violence, or hatred based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected class.
  • Alcohol: Direct promotion or sale of alcoholic beverages without proper age verification and licensing compliance.
  • Firearms: Promotion or sale of firearms, ammunition, explosives, or weapons of any kind.
  • Tobacco/Cannabis: Promotion or sale of tobacco products, vaping products, cannabis, CBD products, or related paraphernalia.

2. Additional Prohibited Uses

You may not use the Service to:

  • Send Spam: Transmit unsolicited bulk messages, commercial content without consent, or any form of spam.
  • Phishing/Fraud: Impersonate others, conduct phishing attacks, or engage in fraudulent schemes.
  • Illegal Activities: Promote or facilitate illegal activities, including drug trafficking, human trafficking, or financial fraud.
  • Malware Distribution: Transmit viruses, malware, or links to malicious websites.
  • Harassment: Harass, threaten, stalk, or intimidate any individual.
  • Privacy Violations: Share personal information of others without their consent.
  • Intellectual Property Infringement: Violate copyrights, trademarks, or other intellectual property rights.
  • Deceptive Practices: Use misleading sender information or deceptive subject lines.
  • High-Risk Financial: Payday loans, debt collection, cryptocurrency schemes, or get-rich-quick promotions.
  • Gambling: Promotion of gambling services without proper licensing.

3. Consent Requirements

All messages sent through the Service must comply with applicable consent laws, including the Telephone Consumer Protection Act (TCPA). You must:

  • Obtain prior express written consent from each recipient before sending marketing or promotional messages.
  • Maintain records of consent, including the date, time, and method of opt-in.
  • Honor all opt-out requests immediately and permanently.
  • Include clear identification of your organization in all messages.
  • Provide a clear opt-out mechanism (e.g., "Reply STOP to unsubscribe").

4. Message Volume and Frequency

  • Do not exceed the message limits specified in your subscription plan.
  • Avoid sending excessive messages to recipients (typically no more than a few messages per day unless they have explicitly consented to higher frequency).
  • Respect quiet hours — avoid sending messages before 8:00 AM or after 9:00 PM in the recipient's local time zone.

5. Carrier and Regulatory Compliance

You agree to comply with:

  • TCPA: Telephone Consumer Protection Act and FCC regulations.
  • CTIA Guidelines: Cellular Telecommunications Industry Association messaging principles.
  • Carrier Policies: Policies of mobile carriers (Verizon, AT&T, T-Mobile, etc.).
  • State Laws: Any applicable state-specific messaging laws.
  • International Laws: GDPR, CASL, and other international regulations if sending to international recipients.

6. Enforcement

We reserve the right to:

  • Monitor message content and patterns for compliance with this AUP.
  • Suspend or terminate accounts that violate this policy without prior notice.
  • Report illegal activities to appropriate law enforcement authorities.
  • Cooperate with carrier investigations into messaging abuse.

Repeated or severe violations may result in permanent account termination and forfeiture of any prepaid fees.

7. Reporting Violations

If you receive an unwanted message from a t3xt.email user or witness a violation of this policy, please report it to:

8. Changes to This Policy

We may update this AUP at any time. Material changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised policy.
